Because over half of our firm's practice consists of prosecuting and defending court cases, we recognize that litigation can create great expense and stress for any client. For those reasons, we assist our clients, before they engage in any court case, in assessing the strengths and weaknesses of their legal position. We commonly find that many clients begin with a misconception of the legal rules, and once we provide an education in those rules our clients gain the ability to make a rational decision about engaging in litigation. We also encourage early settlement of the dispute with the adverse party, if there is any reasonable possibility of gaining a fair settlement. Yet once the decision to go to court is made, we put all of our energy towards a winning strategy.
The cases we handle typically concern real-estate and business disputes. Some examples of those are these:
Boundary disputes
Easements
Landlord-tenant disputes
Corporate shareholder and partnership disputes
Collection of notes and other obligations
Fraud and misrepresentation
Disputes between buyers and sellers under real-estate contracts
Lender-borrower disputes
Property-tax assessments
Zoning and building code enforcement
Attorney Jeffrey P. Widman conducted many trials, both before a judge and before jury. His associate attorneys insist in pre-trial discovery and trial preparation.
We understand the difference between the way a judge or jury arrives at a decision and how an appellate court makes its decision. The process is very different. Our firm has conducted and responded to numerous appeals before the California Court of Appeal and the United States and California Supreme Courts. The appellate courts have published a number of opinions naming Jeffrey P. Widman as counsel of record.
